Can a union employee use the FMLA to use throughout the year to take days off because of asthma, and diabetes?
This employee calls off at least twice a week and says she can’t be fired because of the 12 weeks for FMLA. She intends to take a day off here, a day off there, until her 12 weeks are up. This puts a large strain on the other emploees, who must make up her hours. Can anyone do this for any chronic illness? Is it legal?
Please help as this FMLA policy for chronic illnesses such as diabetes doesn’t seem right.
